Before you publish this page

This is a working outline, not finished legal text. Freight forwarding terms need to reference the standard trading conditions you actually trade under and be reviewed by a lawyer qualified in Japan. Replace this page before going live.

1. Who we are

These terms govern services provided by NipponRoute Logistics K.K., a freight forwarder, NVOCC and licensed customs broker registered in Japan.

2. Standard trading conditions

All business is undertaken subject to the standard trading conditions of the Japan International Freight Forwarders Association, which are incorporated into every contract we enter into. Those conditions limit our liability. A copy is available on request before you make a booking.

3. Quotations

Quotations are based on the information supplied to us and on rates, surcharges and exchange rates current at the date of quoting. They are valid for the period stated on the quotation. If the actual weight, dimensions, commodity or packing differs from what was declared, the rate may be recalculated.

4. The customer's obligations

You warrant that the description of the goods is accurate and complete, that the goods are properly packed for the carriage booked, that any dangerous, restricted or temperature-sensitive nature has been declared to us in writing before booking, and that you are entitled to deal with the goods.

5. Dangerous and prohibited goods

Dangerous goods are only accepted when declared in advance and documented in accordance with the applicable IMDG or IATA rules. Undeclared dangerous goods will be refused, and where they are discovered in transit we may take whatever action is necessary at your cost.

6. Customs

Where we act as your customs broker we do so on the basis of the declarations and documents you supply. You remain responsible for the accuracy of tariff classification, valuation and origin information, and for any duty, tax or penalty arising from it.

7. Charges and payment

Invoices are payable within the period stated on the invoice. Where duties or taxes are advanced on your behalf they are recharged at cost. We may exercise a lien over goods in our possession for unpaid sums.

8. Liability and insurance

Our liability is limited by the standard trading conditions and by the international conventions applying to the carriage in question. Those limits are frequently far below the commercial value of the goods. We strongly recommend separate all-risk marine cargo insurance, which we can arrange on request. We do not insure goods automatically.

9. Claims

Notice of loss or damage must be given in writing without delay and in any event within the time limits set by the applicable convention or trading conditions. Late notice may extinguish the claim.

10. Delivery times

Transit times are estimates given in good faith. We are not a common carrier and do not guarantee arrival on a specific date unless we have agreed to do so in writing.

11. Governing law

These terms are governed by the laws of Japan, and the courts of Yokohama have exclusive jurisdiction.
